1. Acceptance of Terms
These terms of service apply to the YowaGo service ("YowaGo", "we"). By downloading, installing or using the YowaGo application, you agree to be bound by these terms. If you do not accept these terms, please do not use our service.
During the transition to the YowaGo name, the application is still published on the App Store and Google Play as "Tshiakani VTC". These terms apply to that application.
2. Description of Service
YowaGo is a platform connecting passengers with independent car drivers and motorcycle riders in Kinshasa, Democratic Republic of Congo. We provide:
- A mobile application to order a ride (car or motorcycle)
- A service connecting you with independent drivers and riders, who use their own vehicle
- Payment for the ride in cash, directly to the driver
YowaGo asks drivers for documents before activating them. This review is not a guarantee about the driver, their vehicle or the ride.
The service may be temporarily unavailable, in whole or in part, in particular during maintenance or when no driver is available.
3. Registration and Account
3.1 Account Creation
To use YowaGo, you must create an account by providing accurate and complete information, including your phone number and name.
3.2 Account Responsibility
You are responsible for maintaining the confidentiality of your account and all activities that occur under it. You must notify us immediately of any unauthorized use.
3.3 Minimum Age
You must be at least 18 years old to create an account and use our services.
4. Use of Service
By using YowaGo, you agree to:
• Not use the service for illegal purposes
• Treat drivers and other users with respect
• Provide accurate information for your rides
• Pay for completed rides
• Not compromise the security of the platform
5. Pricing and Payment
5.1 Ride Prices
A price estimate is shown before you confirm the ride. It depends in particular on the distance and the vehicle category you choose. The final price may differ from the estimate, sometimes significantly, for example if the actual route, its duration or the waiting time differ from what was expected.
5.2 Payment Methods
Payment is made in cash, directly to the driver, at the end of the ride. No other payment method is offered today.
5.3 Cancellations
You can cancel a ride free of charge. If cancellation fees are introduced, they will be announced in the application and in these terms before they apply.
6. Driver Conditions
6.1 General Conditions
Partner drivers and riders must:
- Hold a valid driving licence for the vehicle they drive
- Provide the documents requested at registration (for example identity document, driving licence, vehicle documents)
- Keep their vehicle or motorcycle in good condition
- Follow the highway code
- Treat passengers with courtesy and professionalism
6.2 Financial Terms
Drivers use their own vehicle. The financial terms of their partnership with YowaGo are communicated to them before they are activated.
7. Limitation of Liability
YowaGo acts as an intermediary between passengers and drivers. We are not responsible for the acts or omissions of independent drivers. Our liability is limited to the amount you paid for the service concerned.
8. Intellectual Property
The YowaGo application, its design, logo and all its content are protected by intellectual property rights. You are not allowed to copy, modify or distribute our content without written permission.
9. Termination
You can ask for your account to be deleted at any time by writing to support (section 12) from the phone number linked to your account. The account is deleted within 30 days. Deleting the account from the application is not available at the moment.
We reserve the right to suspend or terminate your account in case of violation of these terms.
10. Changes
We may modify these terms of service at any time. The date of the last update is shown at the top of this page. Changes take effect upon publication. Your continued use of the service after changes constitutes your acceptance of the new terms.
11. Applicable Law
These terms are governed by the laws of the Democratic Republic of Congo. Any dispute shall be subject to the exclusive jurisdiction of the courts of Kinshasa.
